GENERAL TERMS AND CONDITIONS
- Tony Murland Auctions have the right and its absolute discretion to refuse admission to its premises or attendance at the auctions by any person.
- Tony Murland Auctions have the right and its absolute discretion to refuse any bid, to advance the bidding as it may decide, to withdraw or divide any lot, to combine any two or more lots and, in the case of any dispute, to put up any lot for auction again.
- The Buyer shall be the highest bidder accepted to Tony Murland Auctions and Tony Murland Auctions shall have absolute discretion to settle any dispute.
- Every bidder shall register, giving name and address, providing identification if required by Tony Murland Auctions before making any bid at the auction.
- Each registered bidder will receive a bid number to be recorded alongside his registration details.
- Any representation or statement by Tony Murland Auctions whether on the website or other publication as to the origin, manufacturer, date, age, size, medium, provenance, condition or estimated selling price, of any lot is a statement of opinion only. Any illustrations on the website are solely for guidance and are not to be relied upon in terms of colour or necessarily to reveal imperfections in any lot.
- References given to damage and/or restoration is given as guidance only and the absence of such a reference does not imply that a lot is free from defects nor does the reference to particular defects imply the absence of others.
- Buyers must satisfy themselves as to the matters referred to in 6. and 7. above by inspection or otherwise prior to the date of the auction.
- The Buyer shall pay to Tony Murland Auctions a premium of 10% of the hammer price together with VAT at the standard rate thereon and the Buyer acknowledges that Tony Murland Auctions may also receive commission from the Seller.
- The property in a lot shall not pass to the Buyer until payment has been made in full.
- Methods of payment are: Cash, Cheque (drawn in Sterling or U.S. Dollars), VISA, MasterCard, Sterling or U.S. Dollar Bank Draft or Direct Bank Transfer in Sterling or U.S. Dollars.
- Cheques and bank drafts should be made payable to: Tool Shop Auctions. Bank transfers should be made to: National Westminster Bank, Severalls Industrial Estate, Colchester, Essex. Sort Code 60-06-06, Account 50869620 . The client is asked to ensure that any charges made by the transferring bank are met by the client such that the amount received by Tony Murland Auctions is the exact amount of the invoice.
- The Buyer shall not be entitled to claim under any guarantee for an amount more than the amount paid by him for the lot and in particular shall have no claim for any loss, consequential loss or damage whether direct or indirect suffered by him.
- Tony Murland Auctions offer a confidential sales service acting as the agent for the Seller, and under no circumstance is obliged to offer information regarding the Seller’s identity.
- The Seller of electrical and mechanical goods warrants and undertakes to Tony Murland Auctions and to the Buyer that at the date of consigning the same are safe if reasonably used for the purpose for which they were designed and free from any defect not obvious on external inspection which could prove dangerous to human life or health, and will indemnify Tony Murland Auctions and its employees against any loss or damage suffered by any of them in consequence of any breach of the above warranty and undertaking.
- All lots will be offered subject to a reserve agreed between Tony Murland Auctions and the Seller below which the lot will not be sold.
- Tony Murland Auctions shall have the right to bid on behalf of the Seller up to the amount of the reserve.
- The Seller warrants to Tony Murland Auctions and to the Buyer that he has and will be able to transfer good and marketable title to the lot free from all third party rights or claims.

- All Buyers from the EU are required, by law, to pay V.A.T. on the Buyer’s Premium (ie: 15% on the 10% premium). This does not apply to purchasers outside the EU.
- Please note that the auctioneer will sell at around 220 lots per hour.

Visitors are reminded that there will be active tool selling in the car park at the rear of the Cedars Hotel which we are pleased to encourage, provided all proceeds go to charity.
Whilst in Needham Market, please take time to visit Tony at THE TOOL SHOP, 78 High Street, Needham Market where we offer the largest selection of pre-owned tools in Britain. The shop will be open from 8.30am to 6.00pm on the day of the sale and until 6.00pm the evening before.

How to bid
Please email your bid to us, or alternatively, you may telephone or FAX our office with your bids. We strongly advise that all faxed bids are followed up by a phone call to confirm that we have received them (some faxes do have a habit of "evaporating"!). All bids received are dealt with in the strictest confidence, and no information relating to bids or bidder identity is divulged.
Once all bids have been received, we assess which, in each case, is the highest bid, and transfer that bid to the Auctioneer's sheet. The absentee bid then competes with the bids in the room. If bidding stops in the room below the amount of the absentee bid, the absentee bidder will buy the lot for one bid over the room. For example: a bid is left for £100 by Mr Smith. The room bids the lot up to £70. Mr Smith is successful in purchasing the lot for £75.
Once the sale is over, we work out who has bought what and for how much. We add on the Buyer's Premium, and additions for postage and packing. An invoice quoted in your preferred currency is then despatched to you. On your absentee bidding form there are a number of options regarding how you would like your purchases sent to you. We ask that you select the method you prefer and state it on the form. The methods of shipment available are:
- U.P.S. Express or Expedited air service depending on weight. We add the cost to your invoice.
- Royal Mail, recommended only for light weight shipments.
- Surface (sea) mail. By sea to the U.S.A. takes 28-30 working days, to Australia 42-61 working days, and to New Zealand 59-64 working days, but is economical for heavy shipments.
- Leave the decision to us, and we will calculate the cheapest way to get your shipment to you.
We will send your goods upon receipt of payment. NB. For buyers outside the EU V.A.T @ 171/2% is NOT payable on the Buyer's Premium ,within the EU it IS chargeable.

As over 85% of lots in our Sales sell outside the U.K., it is extremely important for us to ensure that all bids are executed accurately and efficiently to keep the possibility of error to an absolute minimum. To help with your understanding of how we operate we felt it appropriate to mention the following.
- In all cases the highest bid will buy a lot regardless of how much higher it is than any other bid.
- If we receive identical bids on any lot, we reserve the right to increase the bid which is received first by one increment, to clear all other bids. When we assess the absentee bids prior to auction day, we decide what the incremental increases should be for pre-auction processing purposes only. In most cases, for bids in excess of £20, our policy is that our increases should be in increments of £5. Once the auction is underway it is up to the Auctioneer to decide what increments he will use. If he decides to step up the bidding in increments of 1 or 2 pounds, then that is the decision he has taken based on the level of bidding in the room. Currently there is no such thing as a standard increment when the auction is taken as a whole. Prices realised are affected by many factors, including the Auctioneer's discretion. If a buyer in the room shouts out a bid which is out of line with the increments being used by the Auctioneer at the time, the Auctioneer still has to accept the bid. As yet, there are no rules surrounding how much a person is allowed to bid. Once again, we will only introduce an incremental increase on a bid if there is a tie for a lot, i.e., where more than one person has bid the same amount and that amount is the highest received.
- We encourage bids to be submitted as early as possible to allow us the time to process all information ahead of the auction. It may be that by submitting your bid early it will be the first received and therefore subject to an incremental increase in a tie situation. Obviously, the danger in delaying the submission of your bid is that another bidder may end up bidding before you an amount identical to your own bid, thus creating a tie situation, and would end up buying the lot as his was received first!
- Some absentee bidders become frustrated that a lot sells for a small increment above their maximum bid, and ask that we might continue to bid on their behalf. Unfortunately, as we receive thousands of individual bids, we cannot act as monitors once the auction is in progress and continue to bid on behalf of the absentee bidder. We regret that we cannot raise absentee bids further once the auction has started. If you have any questions at all regarding any aspect of this sale, please contact us.
